Opportunity for Implementation of Mining License Transparency in West Nusa Tenggara Province

In Indonesia, extractive industry sector has been non-transparent. Public still faces difficulties to access contract documents and mining permits. In addition, many government officials even insist that the license document is not for public eyes, though the Public Information Disclosure Law Number 14 of 2008 has stated otherwise. Those officials argue that opening the documents would disrupt business competition.

This situation happened in West Nusa Tenggara Province, one of the places where most copper in Indonesia is mined. Public information disclosure in this province remains low. Based on the Information Commission evaluation results in West Nusa Tenggara Province conducted in 2017, the average score of public information disclosure implementation is 37.64 out of 100, which means “not informative”. Poor data and information quality and inconsistent Regional Government Organization in carrying out public information disclosure are the causes.

In 2018, the information disclosure score in West Nusa Tenggara got better. It increased 9.32 point to 46.96/100. This small improvement, at least, gives some positive wave to the implementation of information disclosure in the extractive sector in the Province. However, the local government and civil society still need to work hard to develop various innovation to realize mining permits disclosure.

It is important to identify various challenges and opportunities for implementation of mining license transparency in West Nusa Tenggara Province to ensure the improvement efforts carried out in the future are on target. Therefore, Hivos Southeast Asia supports Publish What You Pay (PWYP) Indonesia to conduct a baseline study on the conditions of information disclosure in the Province.
